Terms of service

1. Identification

This website haribol.pt is operated by Haribol (Sergii Shlykov, sole proprietor, NIF 312722702), based in Lisbon, Portugal.

2. Purpose

These Terms and Conditions govern the access to and use of the website haribol.pt, as well as the purchase and sale of the products offered — fresh microgreens grown to order.

3. Products

The microgreens sold by Haribol are fresh, perishable products grown to order. The growth cycle is 7 to 14 days. Product images on the website are for illustration purposes only. Due to the living nature of the products, slight natural variations in colour, size or volume may occur.

4. Prices

All prices displayed on the website include VAT at the applicable legal rate. Haribol reserves the right to change prices at any time. The price applicable to an order is the one in effect at the time of order confirmation.

5. Orders

By placing an order, the customer declares they are over 18 years of age or have authorisation from a legal guardian. Order confirmation constitutes a purchase and sale agreement between the customer and Haribol. Haribol reserves the right to refuse or cancel orders in case of product unavailability, pricing error or suspected fraud.

6. Payment methods

Haribol accepts the following payment methods: credit and debit cards (Visa, Mastercard), MB WAY, Multibanco reference and PayPal. Payment is processed at the time of order confirmation. All payment data is handled securely through certified platforms and is not stored by Haribol.

7. Deliveries

Mainland Portugal:

Delivery within 2 to 24 hours. Shipping cost: €1.99. Free shipping on orders of €20 or more.

Spain:

Delivery within 24 to 48 hours. Shipping cost: €3.49. Free shipping on orders of €20 or more.

Deliveries are made to the address provided by the customer at the time of order. Haribol is not responsible for delays caused by external factors (weather conditions, strikes, carrier issues). We do not deliver to the Azores, Madeira or Spanish islands.

8. Right of withdrawal

Under Decree-Law No. 24/2014, consumers have the right to withdraw from the contract within 14 days of receiving the product, without the need for justification. However, in accordance with Article 17(d) of the same decree, the right of withdrawal does not apply to perishable products or products with a short expiry date. As microgreens are fresh, living and perishable products, the right of withdrawal cannot be exercised after delivery.

9. Damaged or incorrect product

If the product arrives damaged, in poor condition or does not match the order, the customer has 48 hours after delivery to contact Haribol via the contact form, accompanied by a photograph documenting the issue. After review, Haribol will issue a full refund for the affected product through the same payment method used for the purchase. Returning the product is not required.

10. Cancellations

Orders may be cancelled at no cost as long as they have not entered preparation. Since microgreens are grown to order, cancellation is not possible once preparation has begun.

11. Liability

Haribol is committed to providing fresh, quality products. However, it assumes no liability for individual reactions to product consumption, nor for damage resulting from improper storage by the customer.

12. Intellectual property

All content on haribol.pt — including text, images, logos, design and code — is the property of Haribol and is protected by applicable intellectual property legislation. Reproduction, distribution or use without prior authorisation is prohibited.

13. Data protection

The processing of personal data is carried out in accordance with our Privacy Policy, available at haribol.pt/pages/politica-de-privacidade, and in compliance with the General Data Protection Regulation (GDPR).

14. Alternative dispute resolution

In case of dispute, the consumer may use an alternative dispute resolution entity. More information at www.consumidor.gov.pt. Consumers may also file a complaint via the Electronic Complaints Book at www.livroreclamacoes.pt.

15. Applicable law and jurisdiction

These Terms and Conditions are governed by Portuguese law. The courts of Lisbon shall have jurisdiction for the resolution of any disputes, without prejudice to the mandatory use of alternative dispute resolution mechanisms provided by law.
